Ownership of the Website – www.fattoriadeibarbi.it is the online sales website exclusively owned by Fattoria dei Barbi S.r.l. (hereinafter “Fattoria dei Barbi”), with registered office at Loc. Podernovi 170, 53024, Montalcino (SI), Italy, VAT no. 00726130529.
Background and Acceptance of the General Terms and Conditions of Sale – These general contractual terms (hereinafter the “General Terms and Conditions”) govern Fattoria dei Barbi’s offer of products and services on www.fattoriadeibarbi.it
(hereinafter the “Website”). The General Terms and Conditions must be accepted by the user upon registering on the Website in order to use the services provided. Fattoria dei Barbi reserves the right to amend these terms, in whole or in part, at any time by publishing the updated version on the Website. Users who continue to purchase products and services on the Website and/or use it after the publication of any amendments shall be deemed to have accepted such amendments without reservation.
Website Registration – The Website is intended exclusively for users who are at least eighteen (18) years old. Persons under 18 are not authorised to place orders via the order form available on the Website. All users may, optionally and free of charge, create a personal account on the Website by registering and obtaining a username and password. To register, the user must provide all information requested in the relevant form in a truthful and complete manner and must fully accept the Privacy Policy and these General Terms and Conditions. The user undertakes not to transfer their login credentials to third parties, even temporarily, and to keep them with due care, diligence and confidentiality under their sole responsibility, as such credentials are the only means by which the user is identified and their access to the offers is validated. The user acknowledges that all actions carried out using such credentials shall be attributed to them and shall be binding upon them. Under no circumstances shall Fattoria dei Barbi be liable for any loss, disclosure, theft or unauthorised use by third parties—on any grounds whatsoever—of users’ login credentials. Users may subscribe to the Newsletter by clicking the relevant button during checkout. At any time, the user may update and/or modify, or request deletion of, the information provided prior to purchase and/or during registration. In the event of a deletion request, Fattoria dei Barbi may temporarily retain such information, in whole or in part, solely in order to fulfil purchases already made and/or complete accounting and tax procedures. Fattoria dei Barbi reserves the right to suspend or delete a user’s account at any time and without notice if it believes that: the user has breached these General Terms and Conditions; the user’s access to or use of the service may cause damage to Fattoria dei Barbi, other users or third parties, or may result in a breach of applicable laws or regulations. The suspension or deletion of an account may also be ordered by a competent public authority.
SECTION A — E-COMMERCE (PRODUCTS)
Product Identification – The products offered fall within the categories of alcoholic beverages (wine products) and other accessory products. The products offered for sale on the Website are only those displayed in the dedicated section.
Purchase Procedure and Payment Methods – All purchase requests for products available on the Website must be submitted exclusively through the checkout process on the Payment page. To complete a purchase, the user must enter all requested data accurately and in full and accept the Privacy Policy and these General Terms and Conditions. The user selects the products, completes checkout and—after carefully reviewing the order summary—proceeds to payment of the price, including taxes and shipping costs. Accepted payment methods are: Stripe, bank transfer, and credit/debit card payment apps. The user’s order constitutes a purchase proposal for the selected product(s). Fattoria dei Barbi reserves the right to cancel orders by refunding the full amount paid. The contract shall be deemed concluded and binding on both parties only upon Fattoria dei Barbi’s confirmation of the user’s purchase request, sent by email and containing the order details. Such confirmation constitutes acceptance of the purchase proposal. Payment is charged at the time payment is confirmed. Fattoria dei Barbi uses third-party payment processors and does not, in any way, access the payment data provided by the user (e.g., credit card details). Any changes to an order after submission may be requested via Customer Service, available on business days from 10:00 to 17:00 at +39 335 650 4517 and/or info@fattoriadeibarbi.it. Requests received on public holidays will be handled on the next business day. Shipping is carried out within 3 business days from the order date. Once the parcel is handed over to the carrier, the user will receive an email with tracking details and carrier information; an estimated delivery date will be provided and online tracking will be available. Fattoria dei Barbi shall not be liable for any damage suffered by the user due to delivery delays not attributable to circumstances reasonably foreseeable by the parties at the time the Order Confirmation and Shipment Notice was sent.
Offer Conditions – Before completing the purchase, the user shall review the characteristics of the goods as described in the relevant product page and must comply with any purchase limits indicated therein. Prices (in Euro and inclusive of VAT), descriptions and/or product availability may be amended with effect from the date such changes are published on the Website. The prices applied are those shown on the Website at the time the order is placed. Website prices override and replace any previous prices. Fattoria dei Barbi will make every effort to provide the most detailed product information possible. However, product images and colours may differ from the actual product due to multiple factors, including (by way of example) the user’s monitor settings and photographic filters. The user acknowledges and accepts that such minor differences do not constitute a lack of conformity. Shipping costs vary and may be free when the total order amount exceeds a certain threshold and/or as part of specific promotions. The user is always informed of shipping costs before completing checkout and making payment. Product offers on the Website may be subject to quantitative and/or time limitations which may affect availability. The validity period and/or available quantity of such offers are stated on the Website. Fattoria dei Barbi may change the duration of an offer at its sole discretion, without prejudice to orders confirmed during the offer period. If a product ordered by the user is no longer available after purchase, Fattoria dei Barbi will contact the user to propose an alternative product/service or, if preferred, issue a refund. Products are intended for personal use only. The user declares that they are acting as an end consumer and do not intend to resell the products purchased on the Website and/or by telephone for commercial purposes. Fattoria dei Barbi reserves the right to cancel an order if the user attempts to circumvent purchase limits by:
using a “fictitious” email address associated with a shipping address identical to another registered user;
using a billing address identical to one previously used by another registered user;
entering an invalid or non-existent shipping address.
In any case, Fattoria dei Barbi reserves the right to temporarily suspend sales of certain wines if it detects anomalous orders (for example, unusually high volumes of purchases of certain wines in specific areas).
Discount Codes – Fattoria dei Barbi may issue discount codes (hereinafter “Coupons”) that the user may apply at checkout. Coupons are alphanumeric codes and their function and conditions are determined solely at Fattoria dei Barbi’s discretion. Coupons may be used for a limited time only, after which they expire. A minimum order amount may apply, below which the Coupon cannot be used. Unless otherwise stated, Coupons are personal, linked to the user’s account and valid for a single purchase, after which they are automatically deactivated. Coupons cannot be combined. Coupons may not be sold, assigned or transferred to third parties without Fattoria dei Barbi’s express authorisation. Fattoria dei Barbi may revoke any Coupon previously issued, even before its expiry, without obligation to provide reasons and without any right to compensation. Fattoria dei Barbi may also remove Coupons issued to users who misuse them, without notice and without any right to compensation.
Shipping, Delivery and After-Sales Assistance – Fattoria dei Barbi accepts orders for delivery in Italy, including islands. International shipping is available to the following countries: Andorra, Antigua and Barbuda, Argentina, Australia, Austria, Bahamas, Belgium, Bulgaria, Canada, Colombia, South Korea, Croatia, Denmark, United Arab Emirates, Finland, France, Germany, Japan, Greece, Hong Kong, India, Norway, New Zealand, Netherlands, Portugal, United Kingdom (UK), Singapore, Slovenia, Spain, United States (US), Sweden and Switzerland. For international shipments to other countries, please contact Customer Service at info@fattoriadeibarbi.it and/or +39 335 650 4517 before placing your order. Fattoria dei Barbi undertakes to process orders within 3 business days from the order date. Average delivery times are 24/48 business hours in Italy, except for islands and remote areas where delivery may take 72/96 business hours. For international deliveries, average delivery time is 7 business days. A specific delivery date or time cannot be guaranteed, as this depends on the carrier, destination address and delivery agent. Therefore, Fattoria dei Barbi shall not be liable for any direct or indirect consequence arising from these delivery timelines. Pursuant to Article 61 of Italian Legislative Decree 206/2005 (as amended), delivery times may not exceed 30 days from the day following the transmission of the order. Fattoria dei Barbi shall not be liable for delivery errors due to inaccurate or incomplete information provided by the user, for damage occurring to products after they have been handed over to the carrier, or for delays attributable to the carrier. Fattoria dei Barbi uses patented packaging approved by the carrier and designed to ensure product integrity. Upon delivery, the user must check that the packaging is intact, not damaged or altered (including seals such as adhesive tape or straps), and that there are no liquid leaks. Any damage to the packaging and/or product must be immediately contested by the user by signing the carrier’s delivery document with a written “subject to inspection” note, specifying the reason (e.g., “Packaging pierced”, “Packaging crushed”, etc.). Once the delivery document has been signed without reservation, the user may no longer contest the delivered goods. Any issues concerning physical integrity, correspondence or completeness of the delivered products must be reported within 3 days of delivery by emailing info@fattoriadeibarbi.it
The report must include a description of the defect, the product concerned, the order number, and payment details. If delivery does not take place within the stated timelines, the user must notify Fattoria dei Barbi, which will liaise with the carrier to verify shipment status. In the event of a shipping anomaly (e.g., parcel lost or destroyed during transit), Fattoria dei Barbi will either reship the product (subject to availability) or refund the full order amount.
Product Warranty and Conformity – If any product is found to be non-conforming, the user shall contact Fattoria dei Barbi by emailing info@fattoriadeibarbi.it
Products purchased on www.fattoriadeibarbi.it are covered by the statutory warranty of conformity pursuant to Article 128 et seq. of the Italian Consumer Code. For expiry dates and storage methods, please refer to the information shown on the Website product page and on labels. In case of non-conforming products, Fattoria dei Barbi will arrange collection of the bottle(s) in order to carry out verification. For verification purposes, the bottle(s) must contain at least 70% of the wine and the original cork must be properly inserted in the neck. If the anomaly is confirmed, the product will be replaced or refunded.
Withdrawal (Right of Withdrawal) — Products – The user has the right to withdraw from the contract within 14 (fourteen) days from the date of receipt of the products and to receive a refund of the purchase price without penalty, pursuant to Italian Legislative Decree 206/2005 (as amended). The right of withdrawal must be exercised for the entire order and does not apply to only part of an order. It does not apply to sealed products that have been opened by the user and/or are no longer intact and/or show alterations. The withdrawal notice must be sent by email to info@fattoriadeibarbi.it within 14 days from delivery and must include:
the user’s statement of intention to exercise the right of withdrawal pursuant to Article 54 of Legislative Decree 21/2014;
the products for which withdrawal is requested, including the product code;
the order number;
payment details relating to the purchase;
the completed form “ANNEX – Information on the Right of Withdrawal” (fully completed, otherwise the request cannot be processed).
The user who has exercised the right of withdrawal must return the goods intact, unaltered, in their original packaging (complete in all parts), including the relevant fiscal documentation, within 14 days from the date the withdrawal notice is sent. Return shipping costs are borne by the user. Returned goods must be shipped to: Loc. Podernovi 170, 53041 Montalcino (SI), Italy. The user is responsible for proper packaging of the returned goods and must take all necessary precautions to preserve the integrity of the product(s) and prevent damage and/or alteration. Without prejudice to Fattoria dei Barbi’s right to verify the correctness and conformity of the return, Fattoria dei Barbi will refund the amount paid within a maximum of 30 days from the date on which the seller becomes aware of the exercise of the right of withdrawal. In any event, the refund will not be issued until:
Fattoria dei Barbi has received the returned goods; and
Fattoria dei Barbi has verified the integrity of the returned goods.
The right of withdrawal and the related exceptions apply only to users qualifying as consumers, i.e., users acting for purposes unrelated to their business or professional activity.
SECTION B — EXPERIENCES, TOURS AND HOSPITALITY SERVICES
Booking and Conclusion of the Contract – Experiences (tastings, tours, events, gift cards, etc.) may be purchased exclusively through the Website. The contract is deemed concluded upon:
full advance payment; and
order confirmation by email.
Payment – All experiences must be paid for online in advance. Payment on site is not available unless agreed in writing.
Cancellation Policy – Any booking cancellation must be communicated in writing (by email, WhatsApp or fax). If cancellation is made up to 8 days prior to the scheduled arrival date, no charge will apply. For cancellations after the above deadline and for no-shows, you will be required to pay the full amount of the service even if you do not use it. In summary:
Cancellation at least 8 days before → full refund.
Cancellation less than 8 days before → no refund. 1
No-show → no refund.1
No partial refunds are available.
No Right of Withdrawal – Pursuant to Article 59(1)(n) of the Italian Consumer Code, the 14-day right of withdrawal does not apply to services relating to leisure activities where the contract provides for a specific date or period of performance. Experiences are services provided on a specific date.
Changes or Cancellation by Fattoria dei Barbi – Fattoria dei Barbi may change or cancel experiences due to force majeure or organisational requirements. The customer may choose between rescheduling or a full refund. No further compensation is due.
Late Arrival – Participants must arrive on time. In the event of a delay of more than 15 minutes:
the experience may start as scheduled;
catch-up is not guaranteed;
no refund will be granted.
Access may be denied if the delay compromises the activity.
Alcohol Consumption and Conduct – Tastings are reserved for adults (18+). Participants undertake to:drink responsibly; behave appropriately; refrain from driving if not fit to do so. Fattoria dei Barbi may stop the experience without refund in case of inappropriate behaviour.
FINAL PROVISIONS
Liability of Fattoria dei Barbi – Fattoria dei Barbi shall not be liable for damages arising from use of the Website (including computer viruses, omissions, service interruptions and software malfunctions), including damage to the user’s devices, where such events are due to external causes, force majeure and/or third parties beyond the owner’s control. In any event, Fattoria dei Barbi shall not be liable for delays, defects or non-conformities due to events beyond its reasonable control, including by way of example:force majeure events; events attributable to third parties such as interruption or malfunction of telecommunications services and/or electricity supply, or acts/omissions by carriers or shippers.
Industrial and Intellectual Property Rights – Fattoria dei Barbi owns all rights relating to the Website’s graphic and conceptual content, distinctive signs displayed on it, and any name, symbol, image, logo, drawing and design used to identify products on the Website. Any reproduction, even partial, of the Website content and graphics, as well as distinctive signs displayed therein, is prohibited.
Privacy – Personal data are collected and processed in order to fulfil user requests. Fattoria dei Barbi guarantees compliance with applicable personal data protection laws. The Privacy Notice forms an integral part of these General Terms and Conditions and is available in the Privacy section of the Website or at: https://www.fattoriadeibarbi.it/privacy-policy/ The data controller is Fattoria dei Barbi. At purchase and/or registration, the user may be asked to consent to receiving marketing communications, including newsletters. The user is free to grant or refuse consent.

Governing Law and Jurisdiction – These General Terms and Conditions are governed in all respects by Italian law. For disputes concerning interpretation, performance and/or termination of the contract between the user and Fattoria dei Barbi, the competent court shall be the court of the user’s place of residence and/or domicile where the user qualifies as a consumer pursuant to Italian Legislative Decree 206/2005 (as amended). Otherwise, the competent court shall be Siena.
Reference to Applicable Law – For any matter not expressly provided for herein, the applicable legal provisions governing the contractual relationship entered into online between the user and Fattoria dei Barbi shall apply.
ODR Platform – European consumers are informed that the European Commission has established an online platform for alternative dispute resolution (ODR). This tool may be used by European consumers to resolve out-of-court disputes relating to online sales contracts for goods and services.
